Terms of service

1. Provider and scope

The service is provided by Markus Schmidt IT Beratung, Hackstraße 82, 70190 Stuttgart, Germany, email bms166@gmx.net (“we”, “us”). These terms apply to every use of this service by you (“you”). By ordering credits or using the service you accept them.

2. What the service does

You upload a photo of a plot of land and choose a house model. An AI system creates an image that shows that house on your photo. You pay for this with prepaid credits. One credit creates one image.

3. Who can use it

You must be at least 18 years old and able to enter a contract. The service is not available in every country. We may refuse orders from regions where we cannot lawfully offer it, for example because of sanctions. You can use the service as a consumer or for your business.

After payment you receive an access code that identifies your credits. Anyone who has the code can use the credits. Keep the code safe and do not share it. We are not responsible for credits used by someone who has the code. If you lose it, contact us with your transaction hash. We may be able to restore access once you show that the payment came from you.

Because payments on the blockchain cannot be reversed, we refund only as set out here or where the law requires it.

10. Availability and changes to the service

We work to keep the service available but do not promise uninterrupted use. We may change, limit or end features, for example to keep costs under control or to protect the service against misuse. If we end the service, we will handle unused credits as described in section 4.

11. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only for the breach of an essential contractual obligation (one that the contract is built on and on which you can rely), and then only for the damage that is foreseeable and typical for this kind of contract. We are otherwise not liable for slight negligence. This does not limit rights you have under mandatory consumer protection law.

In particular, we are not liable for payments sent to a wrong address, on a wrong network or in a wrong amount, for changes in the value or availability of any token, or for decisions you make based on a generated image.

12. Ending your use

You can stop using the service at any time. We may suspend or end your access if you seriously or repeatedly break these terms. In that case we will refund unused credits unless the reason for ending is your own abuse or fraud.

13. Governing law and courts

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. If you are a merchant, the courts at Stuttgart, Germany have exclusive jurisdiction to the extent the law allows. For consumers, the mandatory jurisdiction rules apply.

14. Changes to these terms

We may change these terms for good reasons, for example a change in the law or in the service. The version that applied when you ordered stays valid for that order. For later orders the current version applies, and we will show its version number.

15. Severability

If a provision of these terms is invalid, the rest stays in force.
